Rider Agreement

Acknowledgement of risk

Off-road and enduro motorcycling carries a real risk of serious injury, permanent disability and death. That risk comes from terrain, weather, surface conditions, river crossings, other vehicles, livestock and wildlife, mechanical failure, and rider error, and it cannot be eliminated by preparation, skill or equipment.

Much of the riding these files describe is remote. Help can be hours away, and in places it is not reachable at all.

What a GPX file here is

Every track on this site is a record of one ride, on one day, by one rider. It is not a survey, not a recommendation, and not an endorsement that a route is legal to ride, in passable condition, or within any given rider's ability.

Tracks age. Roads wash out, bridges go, gates appear, concessions change hands, and a trail that was open and rideable when it was recorded may be impassable, closed or prohibited today. Distances, durations, difficulty ratings and surface descriptions are the author's own impression and are not measured to any standard.

Legality is the rider's responsibility

Routes may cross national parks, wildlife sanctuaries, non-hunting areas, watershed class land, forest reserves, military and border zones, and private property. In several of these, riding a motorcycle off sealed roads is restricted or prohibited outright, and penalties can include fines, prosecution and confiscation of the motorcycle whether or not the rider owns it.

Determining what applies where you are, obtaining any permit or permission required, and complying with Thai law and the law of any other country you ride in, is yours to do. Nothing on this site grants permission to enter or ride anywhere.

Rider responsibility

You are responsible for holding a licence valid for the machine and the territory, for insurance that actually covers off-road riding where you intend to ride, for the roadworthiness of the motorcycle, and for protective equipment appropriate to the terrain.

You are responsible for an honest assessment of your own skill, fitness and experience against the route in front of you, and for the judgement to turn back. If you are not confident on a given trail, do not ride it.

No warranty

This site and everything on it — routes, tracks, maps, distances, difficulty ratings, itineraries, photographs and written descriptions — is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of accuracy, completeness, currency, merchantability or fitness for a particular purpose.

Assumption of risk and release

You knowingly and voluntarily assume all risks arising from your use of the material on this site, including risks arising from inaccuracy or incompleteness in it.

To the fullest extent permitted by law, you release Chiang Mai Dirt Bike, its operators, contributors and agents from all claims, demands and causes of action arising from your use of the material, whether or not such a claim arises from their negligence.

Limitation of liability

To the fullest extent permitted by law, Chiang Mai Dirt Bike accepts no liability for any loss, injury, death, property damage, prosecution, fine, confiscation, delay or expense arising from use of the material on this site.

Where liability cannot lawfully be excluded, it is limited to the amount you paid for the file in question. Nothing in this agreement excludes liability that cannot be excluded under Thai law, including liability for gross negligence or wilful misconduct.

Indemnity

You agree to indemnify Chiang Mai Dirt Bike against any third-party claim arising from your own riding, your own breach of this agreement, or your own breach of any law or regulation.

No rescue guarantee

Large parts of the terrain described here have no mobile coverage, no reliable access for emergency vehicles, and no organised rescue service. You are responsible for your own communications plan, first aid provision, and evacuation planning, and for telling someone where you are going and when you expect to be back.

Changes and versioning

This agreement is versioned. The version in force when you accepted it is the version that governs that purchase, and is recorded against it. Later changes do not apply retrospectively.

Severability

If any provision of this agreement is held unenforceable, that provision is severed and the remainder continues in full effect.

Governing law

This agreement is governed by the law of Thailand, and the courts of Thailand have jurisdiction over any dispute arising from it.
